These Terms of Service (the “Terms”)govern your use of the DigiTing AI Chatbot (the“Service”), provided by Gate 21 (the “Provider”).

 

1. Acceptance & "Zero Knowledge "Architecture

By initiating a chat session with theDigiTing AI Chatbot, you agree to be bound by these Terms.

You acknowledge and accept the following fundamental characteristics of the Service:

‍

  • Non-Human Interaction: You are communicating with an Artificial Intelligence, not a human being.
  • Infrastructure Anonymity: The Service infrastructure is designed to decouple your identity from your usage. We do not log your IPaddress or assign persistent user identifiers on our servers.
  • Volatile Memory Processing (RAM-Only): You acknowledge that our self-hosted n8n backend processes queries in real-time and holds conversation history temporarily in the server’s volatile memory (RAM) while the n8n process is running. We do not write conversation history to any permanent database or disk. You accept that unless the session is programmatically cleared or the server is restarted, chat history may remain in memory for the duration of the active server process after you close your browser and end your session. Consequently, if you reload the page, or close and open the window again later using the same browser without clearing your cache, your conversation context may be restored from this temporary memory.
  • Third-Party Retention Exception: While Gate 21 does not persist data to disk, you acknowledge that our AI infrastructure provider (GoogleGemini API) mandates a temporary retention of conversation data (prompts and outputs) for 55 days strictly for security and abuse monitoring purposes.

2. Nature and Scope of the Service

2.1. Purpose: The Service is designed solely as an intelligent informational guide to the "Digital 360 Guide" website. It utilizes third-party technology (Google Gemini API) to generate responses based on the website's content.

2.2. Scope Guarding: The AI is instructed to refuse tasks or questions that do not relate to the content, tools, or purpose of the Digital 360 Guide.

2.3. NO DECISION-MAKING AUTHORITY (Crucial Notice): The Service is strictly an informational support tool.

  • No Automated Decisions: The Service does not perform case processing (sagsbehandling),nor does it make any administrative, legal, financial, or binding decisions on behalf of Gate 21.
  • Human Verification Required: Any output provided by the Service is a suggestion only. You generally agree never to make critical business, legal, or technical decisions based solely on the AI's output without independent human verification.

3. User Obligations & Liability for Data Entry

3.1. Prohibition on Personal Data: You agree NOT to input Personally Identifiable Information (PII) such as names, CPR numbers, emails, phone numbers, or health data into the chat.

3.2. Confidentiality: You agree NOT to input confidential, proprietary, or sensitive business data (trade secrets) into the chat.

3.3. User Acknowledgment of Liability: If you voluntarily input PII or sensitive data in violation of Clause 3.1 or 3.2, you explicitly acknowledge that:

  1. This data will be processed by Google Gemini API and retained for their mandatory 55-dayabuse monitoring period.
  2. Gate 21 is technically unable to delete this specific data for you, as we do not persist the Session IDs or IP logs required to locate your data within Google's systems.
  3. You waive any claim against Gate 21 regarding the retention of such voluntarily provided data.

3.4. Conduct: You agree not to attempt to manipulate ("jailbreak") the AI to generate illegal, harmful, discriminatory, or sexually explicit content.

4. Intellectual Property

  • Input: You retain rights to your specific questions but grant us (and our sub-processors) a limited, worldwide license to process them temporarily to generate the answer and for security monitoring.
  • Output: You may freely use the text generated by the AI for your own purposes.
  • Underlying Content: The content of the "Digital 360 Guide" itself, including the knowledge base the AI draws from, remains the exclusive property of Gate21.

5. LIMITATION OF LIABILITY & DISCLAIMERS

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS YOUR RIGHTS.

5.1. "AS IS" and "AS AVAILABLE": The Service is provided without warranties of any kind, whether express or implied. The Provider does not guarantee that the Service will be error-free, uninterrupted, or that the results will be accurate.

5.2. AI Nature & Risk of Error("Hallucinations"): You acknowledge that Generative AI systems are prone to errors, known as "hallucinations" (generating convincing but factually incorrect information).

  • Gate 21 assumes no responsibility for the accuracy, completeness, or currency of the Service's output.
  • It is your sole responsibility to verify facts using the source links provided or official documentation.

5.3. Total Exclusion of Liability: To the maximum extent permitted by applicable Danish law, Gate 21shall not be liable for any damages whatsoever, including but not limited to:

  • Direct Damages: Any immediate loss resulting from your use of the Service.
  • Indirect & Consequential Damages: Loss of profits, revenue, business data, goodwill, or business interruption.
  • Reliance Damages: Any loss resulting from a decision you made or an action you tookin reliance on the information provided by the Service.

5.4. Sole Remedy: If you are dissatisfied with the Service or these Terms, your sole and exclusive remedy is to discontinue the use of the Service.

6. Governing Law and Venue

These Terms are governed by the laws of Denmark. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach there of shall be subject to the exclusive jurisdiction of the competent courts of Denmark.
